The Institut de tourisme et d'hôtellerie du Québec (ITHQ) operates the websites AteliersSAQ.com and ithq.uxpertise.ca (hereinafter called the “Website”).
Please carefully read the terms of use and general terms of sale described below before browsing the Website.
By browsing or ordering products or services from the Website, you acknowledge that you have read, understood, and agreed to all of these terms and conditions.
If you do not want to be bound by these terms and conditions, you may not use the Website or order products or services through this Website.
These conditions may change at any time, and any changes will automatically come into effect.

Changes to the Website
The ITHQ may change these terms and conditions at any time, without advance notice, and these changes shall come into effect automatically. The ITHQ may change or delete any aspect, content or feature of the Website or shut down the Website at any time without notice or liability. The ITHQ may also impose limits on certain services and features or restrict the user's access to all or part of the Website without notice or liability.
Limitation of liability
The ITHQ assumes no liability for any damages, including direct or indirect compensatory damages, or any other damages of any kind whatsoever, which may be caused to users or to any other legal or natural person by any technical equipment or technology, whether on the Website or by any human or technical error, which may occur at any stage whatsoever, or problems or technical malfunctions with the electronic or communications network, online computer systems, servers, computer equipment, software, data transmissions or any other technical, Website congestion or other problem.
Governing law
The Terms are governed by the applicable laws of the Province of Québec. The user acknowledges that any dispute arising out of or relating to the use of ITHQ services and the Website will be submitted to the courts of the judicial district of Montreal, Province of Quebec.
It is forbidden to access the Website from territories or countries whose legislation sets out that the content or use of the Website is illegal. Anyone choosing to use the Website must do so of their own initiative, and it is their responsibility to conform to all applicable local laws.
Copyright
All content (texts, illustrations and images) reproduced on the Website are protected by copyright law as well as intellectual property rights throughout the world and without time limits.
Unless otherwise specified in one or another section of the Website, no part of the Website may be copied, reproduced, distributed, published, translated, downloaded, displayed or transmitted in any manner whatsoever without the prior written permission of the ITHQ. The user may display or download elements of the Website solely for non-commercial purposes and provided that no change is made to these elements and that the user maintains all intellectual property notices that they contain. Any unauthorized use of such content may subject the user to legal action.
Trademarks
Certain names, words, titles, phrases, logos, designs, graphics, icons and trademarks used or displayed on the Website may constitute registered or unregistered trademarks of the ITHQ or third parties. Nothing on the Website may be construed in such a way as to directly or indirectly allow the use of a trademark reproduced on the Website without prior written authorization from the trademark owner.
General terms and conditions of sale
Registration
The minimum age required to register for the Ateliers SAQ par ITHQ is 18.
If you are less than 18 years of age, you may not use the Website without the involvement of a parent or guardian.
Prices
The prices of our products are indicated in Canadian dollars and do not include the applicable taxes. All orders, regardless of their origin, are payable in Canadian dollars. The ITHQ reserves the right to change its prices at any time without advance notice. Products and services are always billed using the rates in effect at the time of the transaction.
Payment
Purchases will be settled by credit card (Mastercard, Visa or American Express). The proposed fees must be paid according to the procedure described at the time of registration. A customer may also pay with a gift certificate previously purchased from the Website.
Fees must be paid as per the procedure described in the registration process. The customer agrees to pay the total cost and related charges for the product or service purchased, including tax. The customer is solely responsible for the payment by credit card for the proposed service. The ITHQ is not liable for payment problems relating to the operations of the e-business service.
Use of gift certificates
- The Ateliers SAQ par ITHQ gift certificates are valid for life until the balance is used up.
- They can be redeemed for registration in SAQ Workshops appearing on the Website. They cannot be redeemed for cash unless the balance is $5 or less.
- If the value of a gift certificate is insufficient to cover the cost of a purchase, the balance of the purchase cost must be paid using another payment method.
- They cannot be replaced or refunded if lost, stolen or damaged.
- The gift certificate has a value in Canadian dollars.
To check the balance of the gift certificate, customers may contact the coordinator of the Ateliers SAQ par ITHQ by calling 1-800-361-5111, extension 4224.
Workshop location
The workshop must be taken in its entirety at the location established at the time of registration. Once a workshop is underway, the workshop location cannot be changed. One workshop cannot be combined with another course.
Modification and/or cancellation of in-person workshops
A customer who wishes to change or cancel a workshop registration must do so at least ten (10) working days before the workshop start date.
After this time, customers who do not attend a course or who cancel their registration will not be entitled to receive a refund or to retake the course on another date.
All requests for changes or cancellations must be made in writing and sent to the following e-mail address: atelierssaq@ithq.qc.ca.
For multi-part workshops, customers may not take a workshop on another date or join another group.
If the number of registrations is insufficient, the ITHQ reserves the right to cancel or postpone any workshop up to a maximum of ten (10) working days before the first day of the workshop.
The ITHQ also reserves the right to cancel or change the workshop date, without advance notice, when health measures or government regulations prevent the workshop from being held.
In these cases only, customers may choose a new available workshop date, sign up for the waiting list for a workshop rescheduled for a later date, or receive a refund.
The participation fees for any workshops cancelled by the ITHQ will be fully refunded.
The online sale of any book, whether in paper or electronic format, is final and no credit or refund will be given.
Participant substitutions
A participant substitution will be accepted at no charge up until the workshop date. However, for this new participant to be authorized to attend the workshop, the customer must advise the ITHQ as soon as possible by calling 1-800-361-5111, ext. 4224, or by sending an e-mail to atelierssaq@ithq.qc.ca.
Cancellation of online workshops
The purchase of an online workshop may be cancelled and a refund issued subject to the following conditions:
- The cancellation request is received by the ITHQ within ten (10) days of the workshop purchase.
- The participant has not yet started the training.
Online purchases of books (whether in paper or electronic format) are final and will not be credited or refunded.
Compliance with COVID-19 measures
When attending a workshop, customers agree to abide by all government regulations in force in Quebec and with any measures imposed by the ITHQ, of any nature whatsoever, without advance notice.
For customers, these obligations include, but are not limited to, wearing a mask or face covering; washing or sanitizing their hands; maintaining the required physical distance from others; filling out any required forms; or presenting any applicable proof of vaccination, if required, at the time of the workshop.
Failure to comply with these obligations may result in the participant's immediate exclusion from the workshop without a refund.
Data collection and privacy
Collection of personal information
The ITHQ only collects the personal information that you provide when registering online or by telephone for workshops and workshop waiting lists, when completing promotional coupons, or when entering promotional contests.
This personal information includes your first name, last name, address, telephone number, email address, gender (male/female), age and, if you agree, certain other information. By providing this personal information, you consent to its collection, use and disclosure for the purposes and in the cases stated herein. Please note that under these Terms, personal information may be disclosed to the SAQ, which is an ITHQ partner. The SAQ and the ITHQ may then communicate with you if you agree to let them do so.
Automatic information collection
The ITHQ acquires and retains certain information whenever users visit the Website. For example, like many website operators, the ITHQ may use cookies to acquire certain information when a browser accesses the Website. The cookies used by the ITHQ do not pose a security risk in that they cannot extract information from a user's hard drive.
When a user accesses the Website, information is automatically exchanged between the Website server and the user's computer with no action on the part of the user. No personal information is included in this exchange. Only the following information, which is used to compile general statistics on use of the Website, is transmitted:
- The Internet domain name and the IP address* from which the user accessed the Website or the address of the referring website.
- The browser and operating system used.
- The date and time of access.
- The pages visited.
Remarketing is used in the context of advertising campaigns aimed at determining user interests and in which third-party vendors, including Google, deliver ads on various websites. The ITHQ and third-party vendors, including Google, use proprietary cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) concurrently to obtain information and to optimize and deliver ads based on website user sessions.
*An Internet Protocol (IP) address is a number code that uniquely identifies a computer connected to the Internet and indicates its location.
How personal information collected by the ITHQ is used
The personal information that the ITHQ collects about you (through the Website or by other means) enables it to process your orders, contact you for purposes relating to courses or contests, provide after-sales service, offer promotions, personalize its relations with you and, if you agree, send you information about the Website and its products and services.
The ITHQ may also use personal information to compile statistics and to the extent required by law, including by court order.
Unless you agree otherwise, the personal information collected by the ITHQ and the SAQ will only be used in accordance with the Terms.
Protection of personal information
The ITHQ takes all necessary precautions to ensure the privacy of the personal information it collects and acts in accordance with the Act respecting access to documents held by public bodies and the protection of personal information (hereinafter the “Act”). Pursuant to the Act, the ITHQ only collects the information required to complete online purchases and information gathered in the context of certain business activities that it conducts or supports. Please note that failure to provide information required for transactions will likely cause them to be declined.
Access to personal information is limited to authorized personnel who require it to perform their duties.
The ITHQ uses means such as data security software, administrative directives and employee awareness and training activities to help ensure the privacy of personal information.
Please note as well that the ITHQ may communicate personal information about individuals without their consent for purposes outlined in the Act or for statistical, research, survey, investigative or audit purposes.
Any request to access or correct personal information must be addressed to the person in charge of personal information protection at the ITHQ.
Information security
Online transactions conducted through the ITHQ meet the security standards for Secure Socket Layer (SSL) certification.
The personal information you provide in the course of such transactions, including those involving credit cards, is thus transmitted by highly secure means in which encryption ensures privacy by protecting the information against any third-party attempts at interception, alteration or decoding.
Credit card transactions are secured and carried out directly by Stripe, an online payments services provider. The ITHQ has no access to personal credit card information (such as card numbers, expiration dates and security codes), so it must be re-entered for each new transaction.
However, no security mechanism is perfect, and there is a slight risk that personal information you transmit to the ITHQ may be disclosed without any fault on the part of the ITHQ and without your consent. The ITHQ disclaims all liability for the disclosure of such personal and private information, except in case of gross negligence on its part.
Third parties with access to personal information
Your personal information may be disclosed to service providers that assist or participate in aspects of our business activities or the management of our services. Our service providers are subject to confidentiality agreements and other legal limitations that prohibit the use of information for purposes other than those that facilitate their particular subcontracting mandates.
The ITHQ may also disclose your personal information to the extent required by law, including by court order.
The personal information about you that is collected on the Website will not be transmitted to third parties unless you provide your written consent. The ITHQ does not share your personal information with its advertisers. Furthermore, the ITHQ does not sell its user lists.
Unless you agree otherwise, the personal information that is collected is shared only between the ITHQ and the SAQ.
The ITHQ may also disclose your personal information to a third party in the event of a change in ownership or the grant of a security interest in all or part of the ITHQ through, for example, an asset or share sale, or some other form of business combination, merger or joint venture, or as required by law.
Submission of personal information
The personal information collected by the ITHQ is handled in accordance with the Act.
As required by the Act, out of the personal information transmitted to the ITHQ via electronic forms or email, only the information needed to reply to and follow up on your messages will be used.
Furthermore, no personal information transmitted to the ITHQ will be disclosed to any other government agency other than the SAQ, which is an ITHQ partner in this mandate, unless the request is directed at such an agency or the disclosure is required by law. In no case will such information be used to create a user profile or transmitted to any private agency.
Links to other sites
The ITHQ is not responsible for the content of sites to which the Website may refer users, nor is it responsible for the privacy policies of these sites. All personal information that you transmit by means of these sites will be subject to the policies governing the protection of personal information of these websites only.
The right to access, correct and delete personal information and questions
